Introduction

Welcome to NextGen Fantasy Football. These Terms and Conditions ("Terms") govern your use of the NextGen Fantasy Football website, mobile application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

The Service is owned and operated by NextGen Fantasy Sports Ltd. ("NextGen," "we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Service after any such modifications constitutes your acceptance of the revised Terms.

Eligibility

The Service is intended solely for users who are 18 years of age or older. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

The Service is intended for entertainment purposes only. Any use of the Service for commercial purposes without our express written consent is prohibited.

The Service contains content owned or licensed by NextGen, including but not limited to text, images, graphics, logos, and software ("NextGen Content"). The NextGen Content is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the NextGen Content solely for your personal, non-commercial use. You may not use, copy, modify, distribute, or create derivative works based on the NextGen Content without our express written consent.

Any content you submit, post, or display on or through the Service ("User Content") is your responsibility. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such User Content in connection with the Service.

Fantasy Contests and Prizes

The Service may offer various fantasy sports contests with virtual or real prizes. Eligibility for participation in contests may vary based on your jurisdiction and applicable laws.

For contests with real prizes:

  • Entry fees and prize structures will be clearly disclosed before entry
  • Prizes will be awarded as described in the contest rules
  • Winners may be required to provide identification for verification purposes
  • Tax implications of receiving prizes are the sole responsibility of the winner

We reserve the right to cancel, modify, or suspend any contest at our discretion. In the event of a dispute regarding contest results, our determination shall be final.

Payments and Refunds

The Service may offer premium features that require payment. By making a purchase, you agree to pay the specified fees. All fees are in the specified currency and are exclusive of applicable taxes unless stated otherwise.

You authorize us to charge the payment method you provide for all purchases you make. If your payment cannot be completed, we may suspend or terminate your access to the premium features.

Purchases are final and non-refundable, except as required by applicable law or at our sole discretion. If you believe you have been charged in error, please contact our customer support team within 30 days of the charge.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION
  • ANY ERRORS OR DEFECTS WILL BE CORRECTED
  • THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEXTGEN, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF THE AMOUNT PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR $100.

Indemnification

You agree to indemnify, defend, and hold harmless NextGen, its affiliates, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to:

  • Your violation of these Terms
  • Your User Content
  • Your use of the Service
  • Your violation of any rights of another

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall be resolved through arbitration in accordance with the rules of the Polish Court of Arbitration. The arbitration shall be conducted in English and shall take place in Warsaw, Poland.

Notwithstanding the foregoing, you agree that we may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or stop any violations of these Terms.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service. All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

General Provisions

These Terms constitute the entire agreement between you and NextGen regarding the Service and supersede all prior agreements and understandings, whether written or oral.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

We may assign or delegate these Terms and/or our Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under these Terms or Privacy Policy without our prior written consent, and any unauthorized assignment or delegation by you is void.
